Board of Appeals

The Board of Appeals is an appointed board, with five (5) permanent members and two (2) alternates. This Board was created under Section 9.5.1 of the Town's Zoning Bylaw, pursuant to Chapter 40A of the Massachusetts General Laws (MGL). Its purpose is to hear and decide appeals from an adverse decision of the Building Inspector or any Town Board, to hear and decide petitions for variances, to make determinations in Flood Hazard Districts, and to issue comprehensive permits under MGL Chapter 40B.  In order to grant a variance from the strict requirements of the applicable Zoning By-Laws, the Board of Appeals must review the hardships as submitted by the petitioner. 

There is no set formula by which the Board can make its decision and each case must be treated individually, must stand on its own merits and is not decided by precedence.

The Board of Appeals meets the FIRST and THIRD TUESDAY of every month in the main hearing room of the Burlington Town Hall, 29 Center St., Burlington, MA.  Please consult the town's calendar to see the agenda.

The Board of Appeals will be holding the
public meetings as a virtual/electronic meeting due to
the current state of emergency as declared by the
Governor due to the Covid-19 virus and pursuant to the
Governor's Executive Order issued on March 12, 2020
authorizing remote meetings under G.L.  c. 30 SECTION 20.

By 2:00 PM on the Following Tuesdays:
August 25th deadline for the September 15th's  meeting
September 15th for the October 6th's meeting
September 29th for the OCtober 20th's meeting
