Minimum Standards for Tanning Facilities

The Board of Health would like to remind parents and children about the Department of Public Health’s minimum standards for tanning facilities.

“No person 14 years of age to 17 years of age, inclusive, shall use a tanning device without prior written consent of a parent or legal guardian who shall indicate therein that such parent or guardian has read and understood the warnings required under the provisions 105 CMR 123.003 (A)(1). The operator must sign the consent form as a witness to the signing by the parent or legal guardian.”

This means the parent or legal guardian must come into a tanning facility, read the warnings and sign in the presence of the tanning facility operator. The tanning facility operator then signs as a witness to the signature of the part or guardian.

Also note that 105 CMR 123.003(B)(1) states in part, “Protective eyewear… shall be made available to the customer before each tanning session with instructions for its mandatory
use.”

The tanning facility operator shall ask the customer to show him/her the eyewear protection before using the tanning device. If a customer cannot provide eyewear, the tanning facility must provide eyewear to the customer.
